ALERT: Commencement of New Stop Bullying and Harassment Scheme
As we wrote about in our earlier article, a new scheme addressing bullying and harassment was passed by the NSW Parliament in July 2025. You can read about the changes here: Stop Bullying and Harassment Orders Coming Soon in NSW.
The NSW Government has confirmed that the changes will take effect from 13 October 2025.
As the changes introduce new forms of relief for aggrieved employees, we expect the Industrial Relations Commission of NSW to provide updated practice notes, application forms, and procedural materials to assist employees and employers in navigating the new scheme.
However, at the time of writing, these materials have not yet been published. Therefore, it remains unclear how an aggrieved employee may seek to exercise their new rights to make applications for stop bullying or sexual harassment orders.
