Contributions cap increased to $30,000 for Growth Centres and other land

A new Ministerial direction on local infrastructure contributions took effect on and from 28 August 2012 (Direction) to increase the cap on contributions for certain land from $20,000 to $30,000.

Like the previous Ministerial direction which took effect on 4 March 2011, the Direction, made under s94E of the Environmental Planning and Assessment Act 1979 imposes caps on the amount of monetary s94 contributions a development consent can require for dwellings and residential lots created by subdivision.

The Direction revokes the Direction of 4 March 2011, but maintains the existing situation with respect to caps on contributions for most of the state.

The cap is, however, increased from $20,000 to $30,000 for certain land within the Queanbeyan City Local Government Area, and land within the North West Growth Centre and the South West Growth Centre.

The Direction applies to all development consents granted on or after 28 August 2012 (including development consents for pending development applications as at that date).
