Victoria McGrath is a Special Counsel at Lindsay Taylor Lawyers.
Victoria has been practising in the field of local government, planning and environment law for over 30 years. She was previously employed by international law firm, Norton Rose Fulbright, in its specialist Environment and Planning team. Prior to that she was employed in a boutique law firm which specialised in planning and local government matters.
Victoria regularly conducts class 1 appeals for local government clients, appearing as advocate or instructing counsel. She has extensive experience in all aspects of litigation, including providing advice on prospects of success, drafting of documents, advising clients on various aspects of litigation, liaising with experts and counsel (both senior and junior), liaising with local residents, appearing in Court and providing advice on appeal prospects. She has also been involved in class 2, 3, 4 and 6 appeals before the Land and Environment Court as well as Supreme Court and Court of Appeal proceedings in relation to planning matters.
Victoria provides advice in relation to all aspects of planning, environmental and local government legislation including Environmental Planning and Assessment Act 1979, Local Government Act 1993, Crown Land Management Act 2016, Companion Animals Act 1989, Heritage Act 1977 and Biodiversity Conservation Act 2016.
In terms of local government matters she has provided advice on matters such as meeting procedure and conflicts of interest, classification of land, compulsory land acquisition, stormwater and drainage works, local approvals, negligence, probity issues for tendering and procurement, the giving of Orders, enforcement and prosecution, public/private partnerships, privacy and public information, rates and charges and fire safety.
Victoria has advised on all aspects of planning, including advice on planning controls, plan making, various aspects of development assessment, development consents and conditions of consent, Crown development, State Significant Development and Infrastructure, existing use rights, development contributions, planning agreements, growth centres, affordable housing, appeal provisions and enforcement provisions.
Victoria regularly works on matters which include issues relating to development which is impacted by Native Title claims; critically endangered and endangered ecological communities under both the Biodiversity Conservation Act (NSW) and Environment Protection and Biodiversity Conservation Act (C’wealth); Crown land and public road access issues, interim heritage orders and affordable rental housing.
