ALERT – Environmental Planning and Assessment Amendment Bill 2017 passed by Parliament

The Environmental Planning and Assessment Amendment Bill 2017 (‘Billwas today passed by the Legislative Assembly. This follows the passage of the Bill through the Legislative Council on Tuesday.

The Bill now awaits Royal Assent.  Section 2 of the Bill provides that the new legislation will commence on a day or days to be appointed by proclamation.

The Bill is the same as that which we discussed last month.

The Bill represents an overhaul of the Environmental Planning and Assessment Act 1979 (‘EPA Act‘) . Key changes include:

  • the introduction of new plans, being community participation plans and local strategic planning statements,
  • extension of the use of voluntary planning agreements to complying development,
  • standardisation of development control plans, and
  • rearranging the EPA Act into a new 10 part structure.

Analysis of these changes, and the implications of other aspects of the Bill, will be covered in a further post as soon as possible.
