UPDATE: Building (Approvals and Practitioners) Bill Passed
In our article published on 22 June 2026 here, we discussed some of the reforms proposed in the Building (Approvals and Practitioners) Bill 2026 (Bill) in respect of prefabricated housing and amendments to the Environmental Planning & Assessment Act 1979 (EPA Act) to replace construction certificates with building approvals and occupation certificates with completion approvals. The NSW government characterises the reforms as streamlining project approvals and supporting the uptake of modern methods of construction.
The Bill has now passed both houses of Parliament.
The majority of the provisions will commence on a date to be set by proclamation.
Some minor amendments to the EPA Act regarding manufactured homes being buildings and permissible when proposed as part of a Crown development application, will commence when the Bill receives assent.
We will provide updates once provisions commence.
