New DCP provisions in force
LTL has previously reported on amendments to the Environmental Planning and Assessment Act 1979 (EPA Act) concerning development control plans (DCPs).
On 1 March 2013, those amendments came into force.
The amendments apply to all DCPs in force immediately before 1 March 2013.
However, the newly inserted s79C(3A) of the EPA Act, which deals with the manner in which a decision maker is required to apply the provisions of a DCP, does not apply to the determination of a development application made before 1 March 2013.
